In a landmark verdict on the rights of Muslim women in India, Supreme Court of India has declared the practice of instantaneous triple talaq as unconstitutional. The supreme court held that triple talaq violates the fundamental rights of the women.

In the 5 bench jury, Justices Rohinton Nariman, Uday Lalit, and Joseph Kurien ruled Triple Talaq to be unconstitutional. While dissenting judgment was given by Abdul Nazeer and Chief Justice JS Khehar. Justice JS Khehar upheld triple talaq as an Islamic custom. The supreme court has given 6 months to the government to bring a legislation on triple talaq. Triple talaq is a contentious issue since a long time and the AIMPLB which fought in the supreme court for the preservation of the custom, has been dealt a serious blow. It is a significant victory for the Muslim women groups who were fighting against it since long. As per an old survey, over 92% Muslim women are unequivocally against triple talaq.

The BJP as well as opposition Congress and CPM have welcomed the court verdict and called it progressive. It only remains to be seen what the Parliament does. It can not blame the judiciary now. Now the ball is in the court of the government to demonstrate the sincerity of their commitment to ban triple talaq.
